The Story
-
Cockroaches noted on Pre-occupancy report,
attachment to lease.
-
Moved in October 1, 2010.
-
Lease notes that pest control treatments
could take 30-45 days
-
Continuous, weekly exterminator visits for
79 days documented as of December 18th, 2010.
-
Requested Siena Gardens to provide an end
date for treatments, or a schedule for treatments so I could adjust my
schedule and make special arrangements for asking friends and family to
move furniture. (see next document)

Treatment expanded to include bedbugs
although I did not report any.

What Siena Gardens
required
weekly to exterminate

Move all furniture and other objects 12" off
the wall
-
Remove everything from window sills.
-
Strip bed of all linens and wash them in HOT
water or dry them in high heat for 10 minutes or more.
-
Leave the unit for one hour, taking all
pets.
-
Vacuum the entire apartment.
-
Ventilate the unit before reoccupying.
-
If you don't do these things, they will try
to charge you $75.00. Tell them to take a hike!

The "Response"
-
Acknowledgement of the
continuous treatment.
-
Acknowledgement of estimated
30-45 day treatment requirement, which was exceeded 100%, as of December
21, 2010.

Unable to estimate schedule
for treatments.
-
Denial of "noxious fumes"
claim, although their instructions require "ventilation of unit before
reoccupying".
-
Attempt to blame me for
their problem.
-
Attempt to shift
responsibility for infestation.
-
Attempt to make me
responsible for future treatment costs, even though they refused to
declare my unit free of insects.

Attempt to Charge a Fee not
covered in Lease

Attempt to charge a $75
fee for my not "being ready" for the 14th pest control treatment, and
threatened a late fee in 3 days.
-
I told them it was not
allowed by the lease and I would not pay it.
-
They dropped the issue.
-
How many tenants do not
know their rights, and would have paid this fee?

"Lost" my rent check
-
On December 3rd I dropped
my rent check in the apartment office designated for payments.
-
On December 6th, they
tried to charge me a $75 late fee.
-
I explained when and where
I provided the payment.
-
They admitted there was a
security problem.
-
They requested I stop
payment on the first check and write a new check.
-
I complied and submitted
my receipt for the stop payment charge.
-
They reimbursed the $29
stop payment charge from my bank and admitted that my first check had
been "stolen".
-
Total time of this
harassment to closure: 39 days.

Official Notice I was vacating
-
128 days of pest treatment
= I MOVED!!
-
No schedule to end the
treatments provided.
-
Verbally accused me of
calling the health department. (I should have, in hindsight)

My rebuttal of the attempt
to shift responsibility.

Expect harassment by a
professional landlord strong arm firm: Continental Collection
Agency. They are unprofessional, nonresponsive and rude.
